Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website operated by Duneland Model Club at dunelandmodelclub.com (the “Site”). The Site serves our scale modeling club community in Northwest Indiana. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Effective date: May 28, 2026

1. Acceptance of Terms

By accessing or using the Site, you confirm that you are at least 13 years of age and that you accept these Terms and our practices described here. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

3. Permitted Use of the Website

You may use the Site for lawful, personal, and non-commercial purposes related to learning about our club, events, news, and community. You agree not to:

  • Use the Site in any way that violates applicable law or regulation
  • Attempt to gain unauthorized access to the Site, member areas, servers, or related systems
  • Interfere with or disrupt the Site or its security features
  • Scrape, harvest, or collect information from the Site by automated means without our prior written consent
  • Transmit malware, spam, or other harmful or disruptive content
  • Misrepresent your identity or affiliation with Duneland Model Club

4. Intellectual Property

Unless otherwise noted, the Site and its content—including text, graphics, logos, photographs, and layout—are owned by Duneland Model Club or used with permission and are protected by copyright and other intellectual property laws. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from Site content without our prior written permission, except as allowed by law.

5. User Content and Submissions

The Site may display or allow submission of content such as gallery images, news, event information, or other materials provided by members or visitors (“User Content”). By submitting User Content, you grant Duneland Model Club a non-exclusive, royalty-free license to use, display, and distribute that content on the Site and in connection with club activities. You represent that you own or have the rights to submit the content and that it does not infringe the rights of others or violate these Terms.

We may remove or refuse any User Content at our discretion, without notice. We are not obligated to monitor all User Content but reserve the right to do so.

6. Member Accounts

Certain areas of the Site, including the member login, are restricted to authorized users. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

7. Third-Party Links and Services

The Site may link to third-party websites or services (for example, social media groups, mapping services, or hosted images). Those sites are not under our control, and we are not responsible for their content, privacy practices, or terms. Your use of third-party services is at your own risk and subject to their policies.

8. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Duneland Model Club disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Duneland Model Club and its officers, members, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site. Our total liability for any claim related to the Site shall not exceed the amount you paid us to use the Site in the twelve months before the claim, or fifty U.S. dollars ($50), whichever is greater, except where such limitation is prohibited by law.

10. Indemnification

You agree to indemnify and hold harmless Duneland Model Club and its officers, members, and volunteers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your User Content, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site shall be brought in the state or federal courts located in Indiana, and you consent to their jurisdiction.
